The PageGlimpse Service (the "Service") is a service offered through this web site (the "Web Site") by RADSense Software.

RADSense Software reserves the right to update and change the Terms of Service from time to time without notice. Any new features added or enhancing the current Service, will be subject to the Terms of Service. Continued use of the Service after such changes constitutes your consent to such changes.

Account Terms

You must be 13 years or older to use this Service.

You must not use or launch any automated system, including without limitation, "offline readers", "spiders," etc. to capture data provided by the Service.

You must provide a valid email address and any other information requested in order to complete the signup or registration process.

You may not use the Service for any illegal or unauthorized purpose. In the use of the Service, you must not violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not interfere or attempt to interfere in any manner with the functionality and proper working of the Services.

Thumbnail images may not be available for all URLs and the images in the Service database may not reflect the most recent and accurate URLs as they actually appear at any given time on the Internet.

You may use data you receive from the Service, such as thumbnail images, web site data, to enhance your Application or website, but may not use it in any Application whose primary purpose is to display the same or related data or whose primary purpose is to compete with www.pageglimpse.com (the “PageGlimpse Website”).

General Conditions

Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.

PLEASE KEEP IN MIND THAT SOME OF THE CONTENT THAT WE MAKE AVAILABLE TO YOU THROUGH THE SERVICE IS UTILIZING SOME OF THE INFRASTRUCTURE PROVIDED BY AMAZON WEB SERVICES. WE CANNOT MAKE ANY GUARANTEES THAT AMAZON WEB SERVICES WILL BE CONTINUALLY PROVIDING THE SAME LEVEL OF SERVICE. ALL SUCH CONTENT IS PROVIDED TO YOU "AS IS." THIS CONTENT AND YOUR USE OF IT ARE SUBJECT TO CHANGE AND/OR REMOVAL AT ANY TIME.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by RADSense Software.

You may not display data you receive via the Service that has been cached for more than 24 hours.

If you make more than 100,000 "Get single thumbnail" or "Exists" API calls a day or more than 1000 "Request URL to be captured" API calls a day, or significantly exceed the average API usage (as determined solely by RADSense), we reserve the right to terminate your use of the service, but we will make the best effort possible to accommodate the increased usage, although a monthly fee might apply in this case.

RADSense does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.

You expressly understand and agree that RADSense shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if RADSense has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.

The failure of RADSense to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and RADSense and govern your use of the Service, superseding any prior agreements between you and RADSense (including, but not limited to, any prior versions of the Terms of Service).
