匯集有關香港競爭法的研究,評論文章、理論及外國的經驗。 A19 時事評論 By 張五常. 65288;五常按：本文是《受價與覓價》的第五章第一節。）反托拉斯（anti trust） 直譯是反信託，俗解是反壟斷。其實不是：本卷第三及第四章提到的所有壟斷反托拉斯皆不反。在美國任教職時我做過兩件反托拉斯大案的顧問，專於此道的行家朋友不少，但說實話，友儕間沒有誰肯定反托拉斯要反的是些什麼。 在美國，政府的某些部門可以按反托拉斯法例起訴私營企業，私營企業之間可以互相起訴，有些案件屬刑事。有兩個明顯的規律。其一是沒有見過小企業或不富有的被起訴；其二是不同政黨執政反托拉斯案件出現的頻率不同：在美國，共和黨執政反托拉斯案件出現的頻率明顯地比民主黨執政為低。換言之，在較為信奉市場的氣氛下反托拉斯的案件較少。 我可以舉兩個有點莫名其妙的例子來示範反托拉斯究竟要反的是什麼不容易明白，二者皆出現在上世紀七十年代民主黨卡達總統執政時期。那時美國經濟不景，反托拉斯案件頻頻出現， 幫補一下經濟學者的生計——做顧問的薪酬比教書的為高。 Rockefeller）把與他有關的四十家企業合併，由一家信託公司集中管...他在上世紀五十年代初期...
