A recurring theme in litigation is burden of proof. For a defendant to be found guilty, all elements of a claim must be proved. This is a large burden for the plaintiff, and I wanted to show the jury how hard it will be to accomplish. The patent at issue contained the key phrase 35 meters at infinity or near infinity. I wanted to show the jury that 35 meters is a small distance, and it should not be considered infinity. The goal was to give the jury a sense of how long 35 meters actually is, using real-world examples. I chose four common objects and compared their sizes in meters. Running the animation, you can clearly see that 35 meters is a very small distance and should not be considered infinity. Click above to play the animation.

My client was accused of fixing the prices of their products. A key component of the amount we owed (damages) was the overcharge percentage. Amount Sold ($) x Overcharge Percentage. See another piece teaching the jury how to calculate damages. The plaintiff claimed the overcharge percentage calculated by our expert was too low, considering how high the overcharge was on certain products.
